Subdivision Plat - Final
Description: By definition, a subdivision consists of 5 or more parcels, lots, or building sites of 1.5 acres each or less in area; or 5 or more parcels, lots, or building sites of 1.5 acres each or less in area created by successive divisions within a period of 5 years. The process to create a subdivision consists of two steps: preliminary and final. Approval or conditional approval of a preliminary plat does not constitute automatic approval of the final plat. Rather, the preliminary plat is an expression of approval or conditional approval of the layout submitted as a guide to the preparation of the final plat, which will be subject to further consideration by the Plan Commission and Common Council at the time of its submission.

Submittal deadline: 4 weeks prior to the Plan Commission meeting (normally held the second and fourth Tuesday of each month)

General review process:
  1. Submittal of application materials. The subdivider submits an application and other required materials along with the application fee.
  2. Distribution. If the City is acting as the transmitting authority, the City Clerk, within 2 days after filing, transmits copies to (i) the County Public Works Department, (ii) the Supervisor of the Plat Review Unit in the Wisconsin Department of Administration for them and for their retransmission of copies to the Wisconsin Department of Transportation if the subdivision abuts or adjoins a state trunk highway or a connecting street and the Wisconsin Department of Industry, Labor and Human Relations if the subdivision is not served by a public sewer and provision for service has not been made, (iii) all affected City boards, commissions and committees, and (iv) the Plan Commission for the Planning staff and for distribution to other City departments.
  3. Review by objecting authorities. Objecting state and county agencies have 20 days from the date of receiving their copies of the final plat, to notify the subdivider and all other approving and objecting agencies of any objections.
  4. Plan Commission recommendation. Within 30 days of the filing of the final plat with the City Clerk, the Plan Commission makes a recommendation to the Common Council to (i) approve the final plat, (ii) approve the final plat with conditions, or (iii) reject the final plat.
  5. Common Council decision. Within 60 days of the filing of the final plat with the City Clerk, unless the time is extended by agreement with the subdivider, the Common Council makes a decision to (i) approve the final plat, (ii) approve the final plat with conditions, or (iii) reject the final plat.
  6. Certification. The Mayor and City Clerk may not inscribe their approval on the final plat unless the City Clerk certifies on the face of the plat that the copies were forwarded to objecting agencies as required, the date thereof and that no objections have been filed within 20 days or, if filed, have been met.
  7. Recording. The subdivision plat is recorded with the Milwaukee County Register of Deeds, provided it is submitted for recording within 6 months from the date of preliminary plat approval or 30 days after the date of final plat approval.
  8. Final Copies. The subdivider submits 10 copies of the final plat as approved to the City Clerk for distribution to the approving agencies, affected utilities and other affected agencies for their files.
  9. Digital file. The subdivider must submit a digital file of the plat in a form acceptable to the City Engineer.
