Board of Zoning & Housing Appeals
Description: Any aggrieved person, or any officer, department, or board of the City who believes the Building Commissioner or Zoning Administrator or another administrative official made an error in an order, requirement, decision, or determination, may appeal such action to the Board of Zoning & Housing Appeals.

Submittal deadline: An administrative appeal must be submitted to the City Clerk within 30 days of receipt of a written decision made by the Building Commissioner or Zoning Administrator, or any administrative official.


Forms: All application forms are posted on the City's website (Licenses & Permits).
 

General review process:
  1. Submittal of application materials. The applicant submits an application and other required materials along with the application fee within the 30-day period.
  2. Determination of completeness. Department staff reviews the submitted materials to determine if the application is complete. If the application is not complete, the applicant will be notified of incomplete or missing requirements.
  3. Public notice. A public notice is published in the City's official newspaper at least 7 days before the public hearing.
  4. Parties-in-interest notice. Department staff sends a notice of the public hearing via regular mail to parties-in-interest at least 10 days before the hearing. Parties-in-interest include (i) the applicant, (ii) the clerk of any municipality whose boundaries are within 1,000 feet of any lands included in the application, and (iii) the owners of all lands included in the application and all lands lying within 300 feet of lands includ­ed in the application.
  5. Notice to DNR. A copy of the application is sent to the Wisconsin Department of Natural Resources (DNR) via certified mail if the appeal relates to the C-1 Shoreland Wetland Conser­vancy District and/or the floodplain regulations.
  6. Public hearing. The Board of Zoning & Housing Appeals conducts a public hearing to accept public input.
  7. Zoning Board of Appeals decision. Within 30 days of the public hearing, the Board of Zoning & Housing Appeals will make a decision to (i) affirm the decision, (ii) set aside the decision, or (iii) modify the decision.
  8. Final decision document. The Board prepares a final decision document. 
  9. Written decision sent to applicant and others. Department staff sends a copy of the decision to the (i) applicant, (ii) City Building Commissioner, (iii) City Zoning Administrator, and (iv) Plan Commission.
  10. Special notice to DNR. A copy of the decision is sent to the Wisconsin Department of Natural Resources (DNR) if the application relates to the C-1 Shoreland Wetland Conser­vancy District and/or the floodplain regulations.
